ScreenPal Supplemental AI Terms

These Supplemental AI Terms (“AI Terms”), together with the ScreenPal Terms of Service (“TOS”) found here cover your use and access to any ScreenPal AI offerings. All capitalized terms not defined herein shall have the meaning attributed to them in the TOS. To the extent that there is any conflict between the TOS and the AI Terms, the AI Terms shall control.

ScreenPal may update these AI Terms from time to time, with such changes effective when posted here. By using or accessing any ScreenPal AI offering, you agree to be bound by these AI Terms.

We may make available to you certain tools or services that utilize artificial intelligence or machine-generated learning (“ScreenPal AI offerings”) to generate and return content (“Output”) in response to input that you provide (“Input”). You understand that ScreenPal AI offerings may generate the same or similar Output for multiple users.

You agree (i) not to provide Input that contains any information that violates the TOS, (2) not to mislead any person or imply that the Output generated using the ScreenPal AI offerings is unique or solely human-generated; (3) not to use the ScreenPal AI offerings or any Output generated by them in any way that violates the TOS, including without limitation the ScreenPal Acceptable Use Policy. The ScreenPal AI offerings may include features or services provided by third parties. You agree to abide by any third party terms applicable to the ScreenPal AI offerings.  Neither ScreenPal nor ScreenPal’s third-party providers will use your Inputs or Outputs to develop or train their artificial intelligence models.

You acknowledge that the ScreenPal AI offerings may generate Output that is inaccurate, unreliable, unsuitable, or offensive, and that access to and use of the ScreenPal AI Offerings is at your sole risk. Use discretion before relying on, publishing, or otherwise using Output provided by or through the ScreenPal AI offerings.

THE SCREENPAL AI OFFERINGS AND ANY OUTPUT PROVIDED BY OR THROUGH THEM ARE PROVIDED ON AN ‘AS IS” AND “AS AVAILABLE” BASIS. SCREENPAL MAKES NO WARRANTY, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTY REGARDING MERCHANTABILITY OR THE FITNESS OF THE SCREENPAL AI OFFERINGS OR ANY OUTPUT PROVIDED BY OR THROUGH THEM FOR A PARTICULAR PURPOSE OR THAT THEY WILL BE SUITABLE OR APPROPRIATE FOR YOUR SPECIFIC REQUIREMENTS. SCREENPAL DOES NOT WARRANT THAT USE OF THE SCREENPAL AI OFFERINGS WILL BE UNINTERRUPTED OR ERROR-FREE AND MAKES NO WARRANTY AS TO THE ACCURACY, RELIABILITY, OR CONTENT OF ANY OF THE OUTPUT PROVIDED BY OR THROUGH THEM.

SCREENPAL SHALL NOT BE LIABLE FOR ANY SPECIAL, INDIRECT, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF PROFITS, ARISING FROM OR RELATED TO THE USE OR MISUSE OF THE SCREENPAL AI OFFERINGS OR THESE AI TERMS, EVEN IF SCREENPAL HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTWITHSTANDING ANY OTHER PROVISION OF THE TOS, YOUR SERVICES AGREEMENT WITH SCREENPAL, OR THESE AI TERMS, SCREENPAL’S AGGREGATE LIABILITY FOR ANY CLAIMS BROUGHT BY YOU OR ANY THIRD PARTY RELATING TO THESE AI TERMS, WHETHER UNDER CONTRACT LAW, TORT LAW, WARRANTY OR OTHERWISE SHALL BE LIMITED TO DIRECT DAMAGES NOT TO EXCEED TEN DOLLARS USD ($10.00).
